Sueing to make a living












In today's landscape its all too easy for those not in love with us as towing pros to find a way to get rich suing us. It only takes one mishap to grab your ass and it can mean loosing the whole operation. I will not sit here and tell you all things are preventable. There are times something you do can really mess up. Even with extreme caution and constant inspections, tow trucks are mechanical, things can break, likewize some idiot can cause you to turn or exceed the limits of your equipment. So yes things can go bad. But if a customer's ride slydes, if your hit, or you cause a real problem , just to get back home where its warm, the damage from legal issues can wipe you out. Even if you win the initial complaint, the costs of litigation can really take a serious byte out of profits. Or get you taken off of a important rotation list. Granted private and commercial accounts can help offset that loss, but not totally cure them. Once labled it can take decades if ever to errode a long legal battle. Denny Jones of Denny's Wrecker Service some years ago ran over by a simple operational error of not securing his brakes, but ran over a little girl in Chubbuck, Idaho. So Denny had to put the company in his sons name and while still going strong, it took Denny years to regain the trust of the area law enforcement agencies, none the less to pay off the law suit. A smaller towing service would have been totally wiped out.
The public is sue happy these days, and there are even more ambulance chasing attorneys out there ready to take cases to make names for themselvez. More over Judges and juries are often siding with the prosecutors of such things rather than the defendants, meaning us in towing. I have been very lucky, in the 33 years I have been actively towing , I have only had one serious suit against me, and only because I had the testimony of area law enforcement on the scene and a always professional and safety reputation did I win that case. If you take the business of towing serious, do your best to be the best you can be and work hard at building a good rep, you can succeed, but that means being careful and looking at the what could happen, and addressing those things can you mke sure your not on the wrong end of that judges hammer.
